WroMigrant: permanent residence permit for a child

In which situations, a minor child of a foreigner can be granted a permanent residence permit?

The legal guardian or parent may apply for a permanent residence permit for a minor child on his/her behalf if:

  • one of the parents has Polish citizenship, and the child remains under his/her parental authority;
  • one of the parents, who has custody over the child, already has a permanent residence permit or an EU long-term residence permit, and the child was born:

– after granting a permanent residence permit or a residence permit of a long-term EU resident to this parent;

OR

– during the validity period of the temporary residence permit of this parent or during his/her stay for humanitarian reasons, tolerant stay, refugee status, or subsidiary protection.
