I received an obligation to return. Can I appeal the decision?
Yes, you can appeal this decision for good reasons. The appeal should be submitted to the Head of the Office for Foreigners through the authority that issued the decision (Border Guard).
The decision on the obligation to return specifies the time you have to return voluntarily, which is from 15 to 30 days, counted from the date of delivery of the decision. The decision contains information whether and in what manner the appeal against this decision is available. This decision is recorded in the foreigner’s passport.
The time for the voluntary return is not indicated if there is a probability of the foreigner’s escape or it is required for reasons of state defense or security. The decision in this case is immediately enforceable.
IMPORTANT: the decision obliging the foreigner to return prohibits re-entry to Poland. This prohibition is issued to the foreigner for a period from 6 months to 5 years.
